The following terms of service are terms of a legal agreement (the “Agreement”) between you (“you”, “your”, or “user”) and Suvi Inc., its subsidiaries and affiliates (collectively, “Suvi”, “we”, “us” and/or “our”) regarding your limited access to Suvi’s websites, mobile application (the “Application”) and/or technology platform (collectively, the Suvi Platform”) for you to be able to receive money (“Pay Anyone Transactions”) from Suvi Account holders (“Suvi Account Holders” through services provided by our banking partner, Community Federal Savings Bank (CFSB). This limited access does not make you a Suvi Account Holder.
While accessing and during your use of the Pay Anyone Transactions, you represent that you will provide correct information such as your name, phone and/or email address, external bank account and debit card information. You represent that you are the owner of the debit card and associated U.S. bank account and/or the external bank account.
You agree that you will not engage in any conduct that would be considered a criminal offense or would give rise to civil liability or violate these terms and the Agreement while accessing and using the Pay Anyone Transactions.
Your access to Pay Anyone Transactions is determined by Suvi and its banking partner, CFSB, in its sole discretion. Suvi and/or its banking partner, CFSB, may suspend or terminate your use of Pay Anyone Transactions at any time and without prior notice to you, including for violating any of their policies or terms and conditions.
If a Suvi Account Holder had sent you funds via the Pay Anyone Transactions, you can either sign-in with your email or phone number that the Suvi Account Holder has used for you the receive funds or click on the link SMS or email you received. Funds sent to you by Suvi Account Holders can be claimed by you within 14 days from the date the Pay Anyone Transaction was initiated by Suvi Account Holder. If such funds are not claimed within 14 days, the funds may be automatically returned to the Suvi Account Holder. There are no fees associated with the use of Pay Anyone Transactions.
At the discretion of Suvi and/or its banking partner, CFSB, you may have the option to either receive the funds as a prepaid card, to your US issued debit card or to your US bank account. You will not be able to receive funds in your pre-paid cards, debit cards issued by foreign banks or credit cards. You may also have an option to open a Suvi Account.
Suvi and/or its banking partner, CFSB may request that you provide additional information to verify your identity or confirm your ownership of your US bank account. We may limit how many Pay Anyone Transactions you can accept, and the amount of funds transferred you can accept in a single day, week, or month. Suvi and its banking partner, CFSB are not responsible if Pay Anyone Transactions are not received due to an error in the information entered by the recipient or additional errors unrelated to Suvi’s Platform. In its sole discretion, Suvi and/or its banking partner may delay or block a Pay Anyone Transactions, if they suspect fraud or another form of financial harm.
You can only receive up to $1,000 per calendar month in Pay Anyone Transactions from all Suvi Account Holders. Suvi and its banking partner, CFSB, reserves the rights to change these limits without notice to you. You may be able to open a Suvi Account and will not be subject to the $1,000 limit.
You may have an option to open a Suvi Account and receive the funds from Pay Anyone Transactions in such account. If you choose such option and your Suvi Account is approved, you will have access to use other Suvi features and become a Suvi Account Holder. Please review all policies and agreements applicable to Suvi users.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. EXCEPT AS REQUIRED BY LAW, SUVI AND ITS BANKING PARTNER DISCLAIM ALL WARRANTIES AND REPRESENTATIONS REGARDING THE SERVICES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, QUIET ENJOYMENT, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, FREEDOM FROM VIRUSES OR OTHER HARMFUL CODE, FITNESS FOR ANY PARTICULAR PURPOSE, OR ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE OR TRADE. SPECIFICALLY, BUT WITHOUT LIMITATION, SUVI AND ITS BANKING PARTNER DO NOT WARRANT THAT: (1) THE INFORMATION PROVIDED IN, OR THAT MAY BE OBTAINED FROM USE OF, THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE CORRECT, ACCURATE, UP-TO-DATE, OR RELIABLE; (2) THE SERVICES BE UNINTERRUPTED OR ERROR-FREE; (3) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED BY OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (4) ANY ERRORS IN THE TECHNOLOGY WILL BE CORRECTED. YOU ASSUME ALL RISK FOR ALL DAMAGES, INCLUDING DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE DEVICE OR LOSS OF DATA THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SERVICE. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542 WHICH PROVIDES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”
Suvi and its banking partner have no liability for your losses or damages resulting from Pay Anyone Transactions including if your bank makes a mistake with the funds, if through no fault of Suvi, you do not properly complete the Pay Anyone Transactions, if Suvi and/or its partner bank’s services weren’t working properly, and you knew about the malfunction when you processed the transfer and if, despite reasonable precautions, circumstances beyond our control (such as fire, flood, power failure, strike, labor dispute, critical service provider failure, computer breakdown, telephone line disruption, government or regulatory action, or a natural disaster) prevent the completion of the Pay Anyone Transactions.
